استقلالية الهيئة الوطنية للوقاية من الفساد ومكافحته باعتبارها تدبير وقائي مؤسساتي

الملخص
ملخص: بات الفساد ظاهرة وليس مجرد جريمة، هذا ما جعل الدول تسعى على اختلافها إلى محاولة التصدي له، خاصة بعدما بلغ مبلغا كبيرا من الجسامة، من أجل هذا وإضافة إلى التدابير التي نص عليها المشرع الجزائري للوقاية من الفساد في قانون الوقاية من الفساد ومكافحته 06-01، فقد نص على تدابير أخرى متعلقة ببعض المؤسسات والهيئات التي تمارس الرقابة لتفادي وقوع جرائم الفساد، وجاء بجملة من النصوص التشريعية والتنظيمية التي تهدف إلى تحقيق استراتيجية وطنية للوقاية من الفساد لحماية الاقتصاد الوطني، وترقية التسيير الحسن للأموال العمومية، ولذلك تم استحداث جهة أطلق عليها اسم السلطة عليا للشفافية و الوقاية من الفساد ومكافحته،ضمن أحكام القانون رقم 22-08 الذي بتحديد تنظيم السلطة العليا للشفافية والوقاية من الفساد ومكافحته وتشكيلها وصلاحياتها , وهي عبارة عن جهاز يلعب دورا بارزا في الوقاية من الفساد من جهة واكتشافه لهذه الجرائم عند وقوعها من جهة أخرى ، وبالتالي له دور وقائي وردعي في نفس الوقت، غير أن الدور الوقائي هو الأساس في إنشاء هذه السلطة..
