إشكالية التمييز بين التحفظات والإعلانات التفسيرية في ظل غياب النص الدولي وتباين الممارسة الدولية

الملخص
يعترف القانون الدولي للمعاهدات بحق إبداء التحفظات، الذي يسمح للدول أو المنظمات الدولية باستبعاد أو تعديل الأثر القانوني لبعض أحكام المعاهدة من حيث سريانها وذلك عن طريق إعلانات انفرادية (تحفظات) غير مقيدة بصيغة أو تسمية محددة، كما تظهر الممارسة الدولية من جهة أخرى جنوح الدول نحو صياغة إعلانات انفرادية (الإعلانات التفسيرية) ذات طابع تفسيري يتيح لها وفق تفسيرها الخاص إبداء إيضاحات حول حكم أو أكثر من أحكام المعاهدة. لقد أدى هذا التباين ما بين أحكام القانون الدولي للمعاهدات المتعلقة بالتحفظات والممارسة الدولية إلى خلق صعوبات عملية، بخصوص التمييز بين التحفظات والإعلانات التفسيرية خاصة في ظل غياب قواعد دولية تكرس وتنظم الإعلانات التفسيرية من جهة، والتفسيرات المتباينة لأحكام القانون الدولي للمعاهدات لا سيما المواد المتعلقة منها بتعريف التحفظات من جهة أخرى. International law recognizes treaties with the right to make reservations, and this allows states or international organizations to exclude or modify the legal effect of certain provisions of the treaty in terms of their applicability, through unilateral declarations (reservations) that are not limited by a specific formula or designation, on the other hand, international practice shows the tendency of states towards formulating unilateral declarations (interpretative declarations) of an interpretive nature, and this allows them, according to their own interpretation, to make clarifications about one or more provisions of the treaty. This difference has led to practical difficulties regarding the distinction between reservations and interpretative declarations, especially with the absence of international rules that establish and regulate interpretative declarations on the one hand, and the different interpretations of the provisions of international law for treaties, especially articles related to the definition of reservations, on the other hand.
