الدور الجزائي في حماية الأملاك الوقفية

الملخص
يمتلك الوقف أهمية ومكانة خاصة وذلك من خلال طبيعته الدينية والتعبدية، فقد ساهم في تحقيق التنمية على الصعيدين الاقتصادي والاجتماعي، وشكّل من خلال ما يتميز به من خصاص ومرونة أحكامه مجالا خصباً لتحقيق أهدافه النبيلة، إلا أن دوره تراجع بشكل كبير نتيجة للممارسات الخاطئة والتي تحول دون تحقيق الأهداف المرجوة منه، وهو ما أوجب التفكير في حماية الأملاك الوقفية للمحافظة عليها، وتعتبر الحماية الجزائية من أهم أنواع الحماية الفعالة لما تحققه من ردع، ومن خلال هذا المقال سيتم توضيح السبل والأليات ومدى قدرة التنظيم الحالي لتفعيل الحماية اللازمة للملك الوقفي بما يجعله يضطلع بالأدوار المنوطة به من الناحية الجزائية والعقوبات المقررة لها.
