الملخص

الملخص: إذا كانت الشركات التجارية تساهم في إثراء الاقتصاد الوطني، فإنها أحيانا تتعرض إلى صعوبات وظروف طارئة تدفع بها للتوقف عن دفع ديونها وإنهيارها، وبالتالي فإنها تتعثر ماليا مما يشكل هذا خطرا على الاقتصاد الوطني، فيؤدي بالشركة المتعثرة إلى الإفلاس وهو يعتبر نظاما خاصا يسري على فئة التجار واداة ردع وتهديد للتاجر الذي ينوي التوقف عن دفع دينه. Abstract : If commercial companies contribute to the enrichment of the national economy, they are sometimes exposed to difficulties and emergency circumstances that push them to stop paying their debts and collapse, and therefore they falter financially, which poses a threat to the national economy, leading the troubled company to bankruptcy, and it is considered a special system that applies to the category of merchants and a tool to deter and threaten the merchant who intends to stop paying his debt.
