الملخص

يمكن رصد مناهج متباينة في تعريف خطاب الكراهية، سواء على مستوى المواثيق والاتفاقيات الدولية أو الإقليمية أو التشريعات الوطنية، كما يلاحظ اتصافها بالغموض والعمومية في مصطلحاتها، وعدم القدرة على تحديد موحد للحدود الفاصلة بين خطاب الكراهية وحرية التعبير، وهذا نتيجة العديد من الأسباب، أهمها عدم وجود اتفاقية دولية لمكافحة والقضاء على خطاب الكراهية، وتأثير العامل الزمني على النصوص القانونية، وغياب التعريفات الدقيقة، واختلاف التسميات، وتأثير الحق في حرية التعبير، وتأثير التضييق والتوسع في مفهوم خطاب الكراهية، والاختلاف حول المحرمات، وعدم توافر القدر الكافي من النقاش، والنقل الجامد عن الاتفاقيات الدولية، وهذا يخلق مشاكل عديدة، جعلت مسألة تعريف خطاب الكراهية مشكلة قانونية، جوهرها صعوبة تحديد الحدود الفاصلة بين خطاب الكراهية وحرية التعبير، وما يتبعه من إشكالات بخصوص عدم القدرة على الوصول لتعريف موحد، وما يثيره من مخاوف على حق الإنسان في حرية التعبير. We can be observed different approaches in defining hate speech, whether at the level of international or regional charters and agreements or national legislation. It is also noted that it is characterized by ambiguity and generality in its terminology, and the inability to unified define the boundaries between hate speech and freedom of expression. And all that is a result of many reasons, the most important of which is the lack of Existence of an international agreement to combat and eliminate hate speech, the effect of the temporal factor on legal texts, the absence of precise definitions, the different nomenclature, the impact of the right to freedom of expression, the impact of narrowing and expanding the concept of hate speech, the difference over taboos, the lack of sufficient discussion, and rigid transmission The issue of defining hate speech is a legal problem, the essence of which is the difficulty of defining the boundaries between hate speech and freedom of expression, and the ensuing problems regarding the inability to reach a standard definition and the concerns it raises on the human right to freedom of expression.
