اللسانيات الجنائية واللغة العربية بين لغة القانون وقانون اللغة Forensic Linguistics And The Arabic Language Between The Language Of Law And The Law Of Language

الملخص
The statement of the relationships between the language of law and the law of language, and what is the limitation of the legal text and the escape of meaning at the different levels of language (phonetic, syntactic, semantic...). Studying linguistic fingerprints and the identity of the author, analyzing the texts of perpetrators and defendants in criminal messages, finding possible ways to combat scientific theft, detecting electronic crimes that include hate speech spread in social media, and analyzing its causes and motives, without forgetting the capabilities of discourse analysis in deciphering criminal messages, is only By employing the capabilities of the Arabic language to make the legal language understandable, especially to ordinary people. Among the most prominent results reached are: the legislator’s failure to keep pace with the new scientific developments in practical life makes the texts different in terms of the aspect for which the text was found or processed, and the presence of legal drafting defects, and almost no law is devoid of that, even with regard to the law of preserving the integrity of the language Arabic, which contains a number of linguistic bodies, which makes it legally flawed and subject to criticism. إن بيان أوجه التّعالق بين لغة القانون وقانون اللّغة، وما يكون من حديّة النص القانوني وتفلُّت المعنى في مستويات اللّغة المختلفة ( الصّوتية ، والتّركيبية، والدّلالية...). ودراسة البصمات اللّغوية وهويّة المؤلف وتحليل نُصوص الجناة والمتّهمين في الرّسائل الجنائية، وإيجاد السّبُل الممكنة لمكافحة السّرقات العلمية وكشف الجرائم الإلكترونية التي تتضمن خطاب الكراهية المنتشر في وسائل التواصل الاجتماعي، وتحليل أسبابه ودواعيه، دون أن ننسى إمكانات تحليل الخطاب في فكّ الرسائل الجنائية، لا يكون إلا بتوظيف إمكانات اللغة العربية في جعل اللّغة القانونية مفهومة خاصّة لدى الأشخاص العاديين. ومن أبرز النتائج المتوصل إليها هي : عدم مسايرة المشرّع للتطورات العلمية المستجدة في الحياة العملية يجعل النصوص مختلفة من الناحية التي وجد النص من أجلها أو معالجتها، و وجود عيوب الصياغة القانونية ، ولا يكاد يخلو قانون من ذلك ، حتى ما يتعلق بقانون الحفاظ على سلامة اللغة العربية ، والذي يحتوي على عدد من الهيئات اللغوية، مما يجعله قانوناً موسوم بالعيب ومحلاً للنقد.
