الملخص

يعتبر التعديل الدستوري الأخير الذي زكاه الشعب بموجب استفتاء الفاتح من نوفمبر 2020، نقطة تحول جذرية وعميقة في إصلاح نظام الرقابة الدستورية كرس من خلاله المؤسس الدستوري قيمة مضافة للقضاء الدستوري الجزائري بإنشاء المحكمة الدستورية بدلا عن المجلس الدستوري بصلاحيات موسعة واختصاصات مستحدثة غايتها تكريس دولة الحق والقانون، بحيث تتجاوز هذه الاختصاصات مهمة ضمان احترام الدستور وحماية الحقوق والحريات لتشمل مهام أعمق تمثلت في التفسير والاستشارة وضبط نشاط السلطات الدستورية والفصل في نزاعاتها. واستنادا على ذلك، سنحاول من خلال هذه الورقة العلمية تسليط الضوء على أهم مستجدات المحكمة الدستورية من الناحية الوظيفية والوقوف على مدى فعاليتها في بناء جزائر جديدة قوامها الحقوق والحريات ودولة القانون والمؤسسات.
