حقيقة الإدماج في سوق الشغل من خلال جهاز المساعدة على الإدماج المهني

الملخص
الملخص: تحت وطأة التحولات الاقتصادية عرفت العقود الأخيرة ارتفاعا قياسيا لبطالة الإدماج التي تتعلق بطالبي الشغل المبتدئين، إلا أن عجز التدابير المتاحة لمكافحة البطالة منذ منتصف التسعينات، حتّم على الدولة ضرورة إعادة النظر في سياسة التشغيل المنتهجة، بتبنّي مقاربة اقتصادية واجتماعية، في إطار جهاز المساعدة على الإدماج المهني سنة 2008 بغية تحقيق الإدماج الحقيقي والفعلي للشباب البطال. وسنبين من خلال هذه الورقة البحثية الطبيعة القانونية الخاصة لعقود الإدماج المهني بالتطرق لعناصر هذه العقود، ونبين أبعادها الاجتماعية والاقتصادية بالنسبة للبطالين والمؤسسات، وتقييم فعاليتها في تحقيق استقرار مناصب الشغل بالإدماج النهائي، وسيتم ذلك من خلال ملامسة الواقع العملي والتطرق لبعض النزاعات القضائية في جوانب الموضوع. Abstract: Under the influence of the economic transformations, the recent decades witnessed a record rise in unemployment integration that relates to primal job seekers. However, the inability of the available measures to fight unemployment since the mid-nineties necessitated the state to reconsider the employment policy pursued by adopting an economic and social approach, within the framework of the integration assistance apparatus vocational education in 2008, in order to achieve the real and the effective integration of young people. In the course of this research paper, we will demonstrate the legal nature of professional integration contracts, by addressing the elements of these contracts, showing their social and economic dimensions for applicants and institutions, and evaluating their effectiveness in achieving stability in job positions with final integration, and this will be done by touching the practical reality and addressing some judicial disputes related to the subject.
