الملخص
تتناول هذه الدراسة دور فقه الموازنات في توجيه الأحكام الشرعية للقضايا الفقهية المعاصرة؛ وتسلط الضوء على الدور المنشود لإعمال المقاصد في تنزيل الأحكام وذلك بالعناية بفقه الموازنات، والتنويه بالاجتهاد المعاصر الواعي لكيفية استثمار المقاصد والذي يسهم في تقديم الحلول الشرعية للقضايا المعاصرة ويبرز حيوية الشريعة ومرونتها، و تتلخص مشكلة البحث في السؤال الرئيسي التالي: كيف يمكن لفقه الموازنات أن يساهم في توجيه أحكام المستجدات الفقهية؟ وتهدف الدراسة إلى: حصر الأسس والضوابط الشرعية التي يجب اعتبارها في فقه الموازنات، وذكر نماذج تطبيقية تبين أثر فقه الموازنات في توجيه أحكام القضايا المعاصرة. إن طبيعة الدراسة المرتبطة بموضوع هذا البحث بشقيها النظري والتطبيقي استلزمت مني اتباع منهج متنوع يجمع بين الاستقراء والاستنباط، و كذا المنهج التحليلي والمقارن. وأخيرا ينتهي البحث إلى أن فقه الموازنات ضرب من ضروب الاجتهاد التطبيقي، يقوم على ضوابط وأسس محددة، يثمر في الأخير تنزيل الأحكام الشرعية بما يتوافق وروح التنزيل والمعاني المصلحية التي يتوخاها الشارع من تشريعه. This study deals with the role of the jurisprudence of balances on directing the Shariah judgements on modern fiqh issues, It highlights the desired role of purposes application in rulings revelation by taking care of the jurisprudence of balances, mentioning the conscious contemporary ijtihad of how to invest purposes which contributes in providing legal solutions to modern issues and highlight the dynamic and flexibility of shariah, The research problem is summarized in the following main question: How can the jurisprudence of balances contribute to directing the judgements of fiqh updates The study aims to: limit shariah's foundations and rules that should be considered in the jurisprudence of balances, mentioning practical examples showing the impact of it in guiding the rulings of modern issues The nature of the study related to the subject of this research in both its theoretical and applied aspects required me to follow a diverse approach that combines induction and deduction, as well as the analytical and comparative approaches Finally, the research concludes that the jurisprudence of balances is a form of practical ijtihad, based on specific rules and foundations, which ultimately results in shariah rulings revelation in accordance with the spirit of them and the beneficial meanings that are taken seriously by the legislator from its legislation
