دور مبدأ الحيطة في حماية المستهلك من المنتجات المعدلة وراثيا

الملخص
دخلت البشرية باستخدام تقنيات الهندسة الوراثية ثورة جديدة أدت لتغيير وجه العالم، حيث يعقد العلماء أمالا كبيرة على التطبيقات الفعلية لهذه التقنية، لاسيما في المجال الغذائي لإنقاذ البشرية من مستقبل غامض محفوف بالمخاطر، بينما عبرت العديد من الدول عن قلقها إزاء السلع المعدلة جينيا واعتبروها مجرد ورطة تكنولوجية، نظرا لتنوع الأضرار التي قد تحدثها سواء على البيئة، أو على الصحة يصعب تداركها أو علاجها، رغم أن الأدلة العلمية الآن ليست حاسمة في هذه المسألة، لذا فقد كان الحل للتصدي لها باعتماد مبدأ الحيطة لمنع أن تكون المنتجات المعدلة وراثيا محلا لأي نوع من النشاطات لحين ثبوت مأمونيتها، وهو ما اعتمده المشرع الجزائري من خلال فرض تدابير احتياطية قبلية تمنع من خلالها وصول تلك المنتوجات إلى المستهلك. Using genetic engineering techniques, humanity entered a new revolution that changed the face of the world in which scientists hold high hopes for the actual applications of this technology, especially in the food field, to save humanity from a mysterious and precarious future, many states expressed concern about genetically modified goods and considered them simply a technological problem, given the variety of damage they may cause both to the environment and to health that is difficult to remedy, although scientific evidence is now inconclusive in this matter, the solution has been to address it by adopting the precautionary principle in order to prevent genetically modified products from being the subject of any kind of activity until their safety has been established, and to avoid any damage to the environment or human health, which the Algerian legislature has adopted through the imposition of tribal precautions to prevent such products from reaching the consumer
