الملخص
الملخص: إن العقد قانون الإرادة و هو نتيجة لمبدأ عريق هو مبدأ سلطان الإرادة ،الذي عرف إزدهارا مبهرا خاصة في ظل المذهب الفردي ، غيرأن إنفرادالإرادة بإنشاء العقد قد يترتب عنه تضمنه عبارات غامضة قد تعيق تنفيذه وتهدد حياته، هذا دفع المشرع للتدخل من خلال نصوص قانونية تمنح القاضي سلطة تفسير عبارات العقد والتي تعد مظهرا للإرادة الموضوعية في التعاقد وقيده بضوابط صارمة حتى يحفظ حرمة العقد وقد ميز المشرع من خلال هذه النصوص بين العبارات الواضحة والعبارات الغامضة .Abstract: The contract is the law of the will, and it is the result of an ancient principle that is the principle of the authority of the will, which has known impressive prosperity, especially under the individualist doctrine. However, the sole will to create the contract may result in its inclusion of ambiguous phrases that may hinder it supplementation and threaten its life .This prompted the legislator to intervene through legal texts give the judge the authority to interpret the phrases of the contract, which are considered a manifestation of the objective will in the contract and restrict it to strict controls in order to preserve the sanctity of the contract. The legislator distingue she through here texts between clear and ambiguous phrases
