الملخص
يهدف هذا البحث لدراسة النزاعات القانونية في مادة متاع البيت، بالإجابة على الإشكالية التالية: ماهي أهم الإشكالات التي تثيرها المنازعات المتعلقة بمتاع البيت كأثر من آثار فك الرابطة الزوجية؟، وذلك باتباع المنهج التحليلي، حيث تم الوصول إلى نتيجتين مهمتين ترصد الإشكالات الإجرائية وتتعلقين أساسا بالمهام المنوطة بقاضي شؤون الأسرة الأولى تتعلق بثغرة قانونية تتعلق بمسألة إثبات وجود المتاع، أما الثانية ترجع إلى ملابسات وحيثيات الفصل في كل قضية خاصة عوامل استنباط القرائن. Abstract: This research aims to study legal disputes in the subject of household goods, by answering the following problem: What are the most important problems raised by disputes related to home goods as one of the effects of breaking up the marital bond? By following the analytical approach, two important results were reached that monitor procedural problems and relate mainly to the tasks entrusted to the family affairs judge. And the rationale of the chapter in each particular case factors for deduction of clues.
