ظاهرة الحالة الخطرة لدى المجرم في ظل السياسة الجنائية

الملخص
الحالة الخطرة للطفل هي حالة في الطفل تتكون من تفاعل عدة عوامل، نفسية واجتماعية وغالبا ما تؤدي إلى بروز ظاهرة الجريمة، وتلعب هذه الخطورة دورا مهما في النظم الجنائية الحديثة، ذلك أن الغرض من العقوبة لم يعد قاصرا على توقيع الجزاء على مرتكب الجريمة لردعه، بل يتعداه إلى غرض آخر وهو اعادة إصلاح المجرم الطفل وتأهليه . إن الكشف عن حالة الخطورة الإجرامية لدى الطفل ليس بالأمر السهل لان ذلك يستلزم إتباع أساليب علمية تعتمد على دراسة منهجية لشخص المجرم ومعرفة حالته النفسية وظروفه الاجتماعية التي أحاطت به وقت ارتكابه لجريمته. Abstract: The dangerous situation of the child is a situation in the child consisting of the interaction of several factors, both psychological and social, which often give rise to the phenomenon of crime, and which plays an important role in modern criminal systems, since the purpose of the punishment is no longer limited to the punishment of the perpetrator to deter him or her, but goes beyond another purpose of rehabilitation and rehabilitation of the child offender. It is not easy to detect the child's state of criminal danger because this requires scientific methods based on systematic study of the offender's person and knowledge of his or her psychological condition and social circumstances surrounding him or her at the time of the commission of his or her crime.
