الملخص
يعالج هذا البحث تصور الفقهاء لكيفية إعمال الشورى على المستوى الإجرائي كمعيار لتحقق الشرعية السياسية استحقاقا وأداء. هذه الفكرة المحورية تتفرع منها ثلاث مسائل عليها مدار البحث وهي: كيفية تحقيق شرعية التمثيل، وكيفية تحقيق شرعية الاستحقاق، وكيفية تحقيق شرعية الأداء. نناقش في المسألة الأولى تصور الفقهاء للهيئة الانتخابية التي يحق لها أن تمثل الأمة وتنوب عنها في اختيار الحاكم، وتحديد المعيار المعتمد في قياس شرعية هذه الهيئة. وفي الثانية نستعرض تصور الفقهاء للصيغ الإجرائية التي اعترفوا بشرعيتها لاستحقاق منصب الحكم. أما الثالثة، فتناقش تصور الفقهاء لحدود إعمال الشورى من حيث هي آلية لإدارة الحكم. وفيما يتعلق بمنهجية الدراسة، يعتمد البحث مدخلا تاريخيا لاستكشاف السوابق التاريخية التي حكمت تصور الفقهاء لهذه المسائل الثلاثة. This research deals with the jurists' perception of the implementation of Shura at the procedural level as a criterion for achieving political legitimacy. From this main idea derives three issues: how to achieve the legitimacy of representation, how to achieve the legitimacy of entitlement, and how to achieve the legitimacy of performance. In the first issue, we discuss the jurists’ perception of the electoral body that represents the nation and acts on its behalf in electing the ruler, and how to determine the legitimacy of this body. In the second, we review the jurists' perception of the procedural formulas that they recognized as legitimate for the entitlement to the presidency. As for the third, we discuss the jurists' perception about how to practice Shura at the level of governance. Regarding the methodology, the research adopts a historical approach to explore the historical precedents that dominated the perception of the jurists about these three issues.
