حق الطفل المريض في احترام حقوقه الشّخصية في الممارسات الطّبية

الملخص
الملخص إنّ المواثيق التي تهتم بشؤون الطفل وتدافع عن حقوقه وحرياته، كانت جميعها تفتقر إلى صفة الإلزام، إلى أن صدرت اتفاقية حقوق الطفل لسنة 1989 التي كرّست مبادئ الطفولة وعملت منظمة اليونسيف على تفعليها وحمايتها، استقطبت العدد الكبير من المصادقات الدولية بشأن حقوق الطفل، وعلى الصّعيد الإقليمي من طرف الدول العربية والإفريقية لتطوير سبل حماية حقوق الطفل من جميع أشكال العنف والاضطهاد. وقد تزداد حساسية الموضوع عندما ترد الأعمال الطّبية على جسم الطفل المريض بسبب ضعفه البدني الذي أنهكه المرض وقصوره العقلي يجعله عرضة لانتهاك خصوصيته. تهدف هذه الدّراسة إلى تسليط الضّوء على أهمية حق الطفل المريض في حقوقه الشّخصية وكرامته الإنسانية، وضرورة ضمان سلامته وحمايته وكذا مشاركته في عملية صنع القرار من خلال استحداث المنظمة الأوروبية للطفل. الكلمات المفتاحية: الطفل المريض ؛ اتفاقيات دولية ؛ اتفاقيات إقليمية ؛ احترام الخصوصية ؛ الكرامة الإنسانية. The subject may become more sensitive when medical work reaches the sick child's body due to his physical vulnerability, which is exhausted by the disease and his mental deficiency makes him vulnerable to privacy violations. This study aims to highlight the importance of a sick child's right to his personal rights and human dignity, and the need to ensure his safety and protection as well as his participation in the decision-making process through the establishment of the European Children's Organization.
