تنسيب الولد غير الشرعي على ضوء الشّرع وقانون الأسرة الجزائري

الملخص
منذ ظهور الإسلام والشّريعة الإسلامية الغرّاء تتشوّف إلى اتّصال الأنساب، والسّتر على المسلمين وإشاعة الفضيلة بينهم، والحِفاظ على تماسك الأسر وترابطها، وفي سبيل ذلك قرّرت في قضايا النّسب حقوقا تتعلّق بالولد، وأخرى تتعلّق بالأمّ، ومنها ما يتعلّق بالأب. فأحاطت النّسب بقيود صارمة وألحقت الأولاد من رباط الزّواج بنسب آبائهم، دون أن تُغفل احتمال وجود أبناء غير شرعيّين في مجتمع مسلم، فقضت ببراءته من خطيئة والديه، وقرّرت له سائر حقوق الأبناء الشّرعيّين، ليواصل فقهاء هذا الشّرع الحنيف مساره العادل. فأثاروا مسألة تنسيبه لأبيه ووقفوا من ذلك بين مُجيز ومانِعٍ، وما كان من المشرّع الجزائريّ رغم موقفه الغامض إلاّ أن تبنّى الرّأي القائل بعدم تنسيب ولد العاهر لأبيه. الكلمات المفتاحية: النّسب – الولد غير الشرعيّ – الزّنا – ولد الزّنا – التّشريع - القضاء. Abstract: Since the advent of Islam and Islamic law, the glue has longed for the connection of lineages, the concealment of Muslims and the spread of virtue among them, and the preservation of family cohesion and interdependence. For this, I decided in lineage issues rights related to the child, and others related to the mother, including those related to the father. So the lineage surrounded strict restrictions and attached the children from the bond of marriage to the lineage of their fathers, without neglecting the possibility of the existence of illegitimate children in a Muslim society, so it judged his innocence of the sin of his parents, and decided for him all the rights of legitimate children, so that the jurists of this honorable law continue its just path. They raised the issue of his assigning him to his father, and they stood between a permit and a prohibition, and the Algerian legislator, despite his ambiguous position, was only to adopt the opinion that the son of a prostitute should not be assigned to his father.
