الاستثمار في نظام الوقف عن طريق الشراكة بين القطاع العام والخاص

الملخص
نظام الوقف هو حبس العين عن التملك فإذا تم الوقف بشروطه وأركانه زال حق الملكية عن الواقف وآل حق الانتفاع إلى الموقوف عليه، كأصل عام لا يجوز التصرف في الملك الوقفي بأي تصرف ناقل للملكية، إلا أن هذه الفكرة تعتبر مرنة من حيث طرحها، فالوقف باعتباره دائما ومؤبدا قد ترد ضرورات عملية تجعله قابلا للتصرف فيه، حيث انه إذا خرب ولم يرج منه نفع كان من اللازم التصرف فيه تحقيقا لمصلحه الوقف وذلك عن طريق تطوير وسائل وأساليب استثماره بشكل يحفظ كل من خصوصيته ويضمن تحقيق النفع منه. The waqf system is the detention of a specific thing in the ownership of wakf. If it is fulfilled under its conditions and pillars, the right of ownership and the right to use the waqf will transport from the waqif ( doner) to the beneficiaries. As a general principle, It is not permissible to dispose of the Waqf property by any transfer of ownership, but this idea is flexible in terms of its proposition .since wakf is given As an eternal donation for life, there may be practical necessities that make it disposable, as if it is destroyed and the benefit from it is no longer possible, it would have to be disposed of for the benefit of the waqf by developing means and methods of investment in a manner that preserves both its privacy and ensures the extraction of benefits of it. Le système du waqf est la détention d'une chose spécifique dans la propriété du wakf. S'il est rempli dans ses conditions et ses piliers, le droit de propriété et le droit d'utilisation du waqf seront transportés du waqif (donateur) aux bénéficiaires. En tant que principe général, il n'est pas permis de disposer des biens du waqf par tout transfert de propriété, mais cette idée est flexible en termes de proposition. Puisque le wakf est donné comme un don éternel pour la vie, il peut y avoir des nécessités pratiques qui le rendent jetable, comme s'il est détruit et le bénéfice de lui n'est plus possible, il devrait être disposé pour le bénéfice du waqf en développant des moyens et des méthodes d'investissement d'une manière qui préserve à la fois son intimité et assure l'extraction des avantages de lui.
