مسؤولية المرفق الطبي والدولة عن التلقيح ضد فيروس كورونا

الملخص
تسهر الدولة عبر كل مرافقها الحفاظ على سلامة صحة مواطنيها، ونتيجة لتفشي فيروس كورونا )كوفيد 19 ،)عبر المعمورة بسرعة هائلة، سعت الجزائر كغيرها من دول العالم إن لم نقل كانت السباقة في الدول العربية والإفريقية إقتناء اللقاح الخاص بهذا الفيروس، قصد تلقيح ما تستطيع تلقيحه من عمال الصحة كأول الملقحين ، لتعمم ذلك على باقي المواطنين حسب إمكانيات المسخرة لذلك، إلا أن الهاجس الذي يراود مستعملي هذا اللقاح، هو مدى نجاعته لأنه لم يحظى بالقدر الكافي من التجارب السريرية، وخوفا من تعرض آخذي هذا اللقاح لمضاعفات غير مرغوب فيها وقد تودي بحياة الملقحين الأمر الذي يترتب عنه مسؤولية ومن يتحملها، لنحاول في هذه الورقة البحثة تحديد المسؤولية الناتجة عن تلقي هذا اللقاح وعلى من تقع هذه المسؤولية لأنها تؤخد على مستوى مرافق الدولة الصحية. The state through all its facilities ensures the safety of health of its citizens, and as a result of the spread of the coronavirus across the globe at tremendous speed. Algeria like the other countries in the world sought, if not to say, was the first one in the Arab and African countries to acquire the vaccine for this virus, in order to vaccinate what it can vaccinate the health workers as the first vaccination and to circulate it to the rest of the citizens according to the capabilities devoted to that. However, the obsession with users of this vaccine is the extent of its effectiveness because it did not have enough clinical trials. And for fear that those who taking this vaccine may face unwanted complications that may claim the lives of the vaccinated. The matter that leads to responsibility and who bears it. So in this paper research, we try to determine the responsibility resulting from receiving this vaccine and who is responsible for it, because it is taken at the level of state health facilities
