مدى حجية الاقرار الناتج عن وسائل التحقيق الحديثة دراسة مقارنة في القضاء الاسلامي و التشريعات الحديثة

الملخص
يهدف البحث إلى دراسة مدى إمكانية تدعيم نظام القضاء الإسلامي بما استجد من تقنيات ووسائل معاصرة؛ من خلالها يتم السعي إلى انتزاع إقرار المتهم أثناء التحقيق دون رغبته، ومقارنة ذلك مع التشريعات الدولية، ويناقش البحث الإشكالات التي ترد على حجية هذه الوسائل؛ ليختم البحث بما تمخض عن المناقشة من نتائج؛ داعيا إلى تطوير هذه التقنيات وضبطها من الناحية العلمية، وإعمالها فيما لا يعارض قواعد الشريعة الإسلامية ومبادئ القانون. The research aims to study the possibility of strengthening the judicial system with modern technologies and methods ; through wich is sought to extract the confession of accused during the investigation whithout his wich, and compared it with international legislation, the research disscuses the problems that confront the authenticity of these means ; the research concludes with a result of the discussion ; calling for the developement of these technique and control in terms of science, and its implementation in a matter that does not oppose the rules of islamic law and the principles of law.
