الملخص
يهدف هذا البحث إلى دراسة معرفة مفهوم فقه الموازنات من خلال مفهوم العلماء القدامى والمعاصرين له، وشواهد اعتباره من النصوص القرآنية والأحاديث النّبّوية الشريفة، وإجماع العلماء، ونتاج العقل، ثم أثر هذا الفقه في المجال الطبي خاّصّة ما تعلّقّ بتصرّفّات الطبيب والمر يض أثناء تخدير المريض للتداوي، وما يترتّبّ عليه من مصالح أو مفاسد، ومن ثمثمّ إعطاء الحكم الشرعي المناسب بناء على هذه الموازنة التي تحتكم إلى مقاصد الشريعة الإسلامية والقواعد الفقهية وأبواب أصول الفقه المختلفة، ليظهر لنا بعد ذلك حقيقة هذا الفقه وأهميته في حياة النّاّس، وإبراز وسماحة ووطية هذا الدين الحنيف. The purpose of this research is to study the knowledge of the concept of the jurisprudence of budgets through the concept of ancient and modern scholars, and the evidence of the Quranic texts and Hadiths, and the consensus of scholars, and the product of the mind, and then the impact of this jurisprudence in the medical field, especially related to the behavior of the doctor and the patient during anesthesia patient to cure, And the consequent interests or misdeeds, and then give the appropriate Islamic judgment on the basis of this budget, which is under the objectives of Islamic law and jurisprudential rules and the doors of the fundamentals of jurisprudence, to show us then the fact of this jurisprudence and its importance in the lives of people, and highlight and permissibility and .patriotism The true religion
