أحكام دور الدولة الخاصة بالأطفال في قانون الرعاية الاجتماعية العراقي The Provisions Of State Houses For Children In The Iraqi Social Care Law

الملخص

يتناول هذا البحث أحكام دور الدولة الخاصة بالأطفال في قانون الرعاية الاجتماعية العراقي. والغرض منه هو بيان هذه الأحكام وإزالة الغموض الذي يعتريها، وتعين مواضع التعارض والتناقض بين هذه الأحكام. واختتم البحث بنتائج وهي: أن دور الدولة مؤسسات حكومية خاصة للأطفال تهدف إلى رعايتهم وكفالتهم وتربيتهم، وهي على أربعة أنواع: دور الدولة (للأطفال، للصغار، للأحداث، للبالغين)، ونظام الدوام فيها لمدة (24) ساعة مقسّم على ثلاث وجبات، وأخيراً جميع الخدمات التي تقدم للمستفيد مجانية. أما بالنسبة لحالات التعارض والتناقض، فبموجب القانون الأطفال الأيتام وكل من يعاني مشاكل أسرية يمكن قبوله في الدار، أما نظام دور الدولة فحصره بالأيتام فقط. وفي الوقت الذي عاقب النظام المستفيد الذي يحمل الآلات الجارحة والراضة داخل الدار بتخفيض مصروف جيبه اليومي لمدة محدودة، عاقبته التعليمات بالفصل من الدار. This research deals with the provisions of state houses for children in Iraqi social care law. Its purpose is to clarify these provisions and remove ambiguity in them, and to identify the places of conflict and contradiction between these provisions. The research was concluded with results, which are: The state houses are governmental institutions private for children aim to take care of them, ensure them and raise them. They are of four types: state houses for (children, young children, juveniles, adults). The working system is (24) hours, divided into three shifts. Finally, all the services provided to the beneficiary are free. As for the cases of inconsistencies and contradictions, under the law, orphaned children and anyone who suffers from family problems can be accepted into the house, while the state house system restricts it to orphans only. While the system punished the beneficiary who carries traumatic and concussive instruments inside the house by reducing his/ her daily pocket money for a limited period, the instructions punished his/her with dismissal from the house.
