تقدير سلطة مجلس الأمن في تكييف حالة ليبيا بأنها تشكل 'تهديد للسلم والأمن الدولي' وتكليف حلف الناتو بأداء المهمة على هذا الأساس

الملخص
أهدف من خلال هذه الدراسة إلى إبراز طبيعة تفويض مجلس الأمن للتدخل العسكري في ليبيا، من منطلق إحالته للوضع الإنساني الذي كان سائدا فيها آنذاك، إلى المحكمة الجنائية الدولية، على أساس أنه يشكل فعلا تهديدا للسلم والأمن الدولي (منهج تحليلي). ما يرجح هذه الفرضية، أنه جاء في سياق أحداث الربيع العربي، (منهج تاريخي). ولإدارة أي مرحلة انتقالية خلالها، فإنه يفترض في أي استراتيجية أي كانت طبيعتها والغرض منها، عدم جواز تفويض ولو جزء من سيادتها الوطنية لحلف الناتو بالذات. حيث خلصت في الأخير لنتيجة مفادها، ضرورة استحداث نظريات تفويض أخرى، تكون مبررة لتدخلات مماثلة مستقبلا. This study aims to determine the nature of this mandate forI aim through this study to highlight the nature of the SC’s mandate for military intervention in Libya, in terms of referring humanitarian situation that prevailed there at the time to the ICC, on the grounds that it constitutes a threat to international peace and security (analytical approach). What makes this hypothesis is that it came in the context of the events of the Arab Spring (historical approach). And an administration that is any transitional phase during it, it is assumes in any strategy, whatever its nature and purpose, requires a commitment not to delegate even part of its national sovereignty to NATO in particular. Ultimately, I concluded that it was necessary to develop other mandate theories, which would justify similar interventions in the future.
