اجراءات المتابعة في جريمة اختلاس المال العام في التشريع الجزائري

الملخص
للمال العام اهمية كبيرة لضمان قيام المؤسسات العامة للدلة أو المؤسسات ذات النفع العام بوظائفها الأساسية ،ومن أجل تحقيق ذلك كان لابد على المشرع توفير الحماية القانونية اللازمة لهذا المال وتحصينه من أي اعتداء قد يقع عليه لاسيما من طرف القائم عليه وهو الموظف والذي يمثل في عمله سلطة الدولة في حدود اختصاصه ،فمن أخطر الأفعال التى قد تصدر من هذا الاخير هو اختلاس هذا المال وتبدده وهو بذلك يخون تلك الثقة الموضع على عاتقه و التى بموجبها يلتزم بالامانة والنزاهة أثناء تأديته لعمله. هذا ما دفع بالمشرع الجزائري الى تجريم فعل الاختلاس الصادر من الموظف من خلال سن قوانين خاصة تتضمن احكاما واجراءت مميزة ويتعلق الامر بقانون رقم 06-01 المتعلق بالوقاية من الفساد ومكافحته متداركا ما لم يتضمنه قانو العقوبات فيما يخص هذه الجريمةAbstract Public money is of great importance to ensure that public institutions of the state or institutions of public interest carry out their basic functions, and in order to achieve this, the legislator had to provide the necessary legal protection for this money and immunize it from any attack that may occur on it, especially by the person in charge of it, the employee who represents in his work an authority The state within the limits of his competence, one of the most dangerous acts that may be issued by the latter is the embezzlement and waste of this money, and thus he betrays that trust placed on his shoulders, according to which he is committed to honesty and integrity white performing his work. This is what prompted the Algerian legislator to criminalize the act of embezzlement issued by the employee through the enactment of special laws that include distinct provisions and procedures, and the matter is related to Law No. 06-01 related to the prevention and control of corruption, addressing what is not included in the Penal Code with regard to this crime.
