الملخص
ليس من شك في أن كل الدول الحديثة تسعى إلى حماية سيادتها وحراسة مصالحها الحيوية، وتبتدع من أجل ذلك الآليات الكفيلة بها، ويأتي على رأس المصالح الحيوية للدول نظامها الاقتصادي والتي تندرج فيه العملة الوطنية لكل دولة باعتبارها تعبر عن سيادتها، ناهيك عن قيمتها الاقتصادية، ذلك أنه انطلاقا من القرن العشرين وبعد تخلي الدول تدريجيا عن "قاعدة الذهب" التي كانت تضمن ثبات سعر العملة في المعاملات الخارجية، ونظرا لاختلال ميزان مدفوعات الدول غداة الحرب العالمية الأولى، ظهرت فكرة الرقابة على النقد للمحافظة على سعر مناسب له . وعلى الرغم من الآليات التي اتبعتها الدول لتحقيق هذه الرقابة على النقد، فإنها لم تفلح في تحقيق الأهداف المرجوة منها، وهو ما عرض مصالح الدول الاقتصادية للخطر، مما استدعى اللجوء إلى وسائل القانون العقابي باعتباره وسيلة الدولة الفعالة لحماية مصالحها وذلك عن طريق التجريم والعقاب، إذ تم تجريم كل الأفعال المرتكبة مخالفة للتنظيم الخاص بالصرف وحركة رؤوس الأموال There is no doubt that all modern countries seek to protect their sovereignty and guard their vital interests, and for this they invent mechanisms to guarantee them. Starting from the twentieth century and after countries gradually abandoned the “gold rule” that ensured the stability of the currency price in foreign transactions, and due to the imbalance in the balance of payments of countries in the wake of the First World War, the idea of controlling cash appeared to maintain an appropriate price for it. Despite the mechanisms that countries have followed to achieve this control over cash, they have not succeeded in achieving the desired goals, which has jeopardized the economic interests of the countries, which necessitated resorting to the means of punitive law as the effective means of the state to protect its interests through criminalization and punishment. All acts committed in violation of the regulation of exchange and capital movement have been criminalized
