الملخص

يعتبر طلب إثبات الحالة من الطلبات التي اعتاد عليها الناس في الحالات المستعجلة، حيث يهدف هذا الطلب إلى دفع ضرر قد يتعذر تلافيه في المستقبل، وذلك بإثبات واقعة يحتمل ضياع معالمها، وحيث أن إشكالية الدراسة تحوم حول بيان مدى فعالية النصوص القانونية المتعلقة بأحكام طلب إثبات الحالة الواردة في قانون أصول المحاكمات المدنية والتجارية الفلسطيني رقم (٢) لسنة ٢٠٠١م خاصة الشروط منها، وقد توصل الباحثان مجموعة من النتائج اهمها أن من شروط طلب إثبات الحالة: شرط الاستعجال وشرط عدم المساس بأصل الحق وشرط احتمالية وجود الحق والاعتداء عليه والضرر المحتمل وشرط جدية النزاع ووجود احتمال أن تصبح محل نزاع أمام القضاء إضافة إلى ضرورة استلزم شروط قبول الدعوى والمتعلقة بالصفة والمصلحة والأهلية بالمستدعي الذي يريد رفع طلب اثبات الحالة وقد أوصينا المشرع الفلسطيني بتعديل المادة رقم (١٠٣) من قانون أصول المحاكمات المدنية والتجارية رقم (٢) لسنة ٢٠٠١م وتفعيل دور قاضي الأمور المستعجلة على أرض الواقع. The request to prove the case is one of the requests that people are accustomed to in urgent cases, as this request aims to pay damage that may not be avoided in the future, by proving a fact whose features are likely to be lost, and since the problem of the study revolves around the statement of the effectiveness of the legal texts related to the provisions of the request to prove the case Listed in the Palestinian Civil and Commercial Procedures Law No. (2) of 2001, especially the conditions thereof, and the researchers reached a set of results, the most important of which are the conditions for requesting proof of case: the condition of urgency, the condition not to prejudice the origin of the right, the condition of the possibility of the existence of the right and its assault, the potential harm, and the condition of seriousness of the dispute The presence of the possibility that it may become a subject of dispute before the judiciary, in addition to the necessity, necessitates the conditions for accepting the case related to the capacity, interest and eligibility of the petitioner who wants to file a request to prove the case. Urgent matters judge on the ground.
