الملخص
الملخص: لقد حاولنا من خلال هذه الدراسة الموسومة "بمسؤولية الطبيب عن الخطأ الطبي" توضيح مفهوم الخطأ الطبي والذي هو نتاج التطور المتسارع في المجالات الطبية وما يترتب عنه من زيادة في التعقيد والخطورة؛ وقد تترتب مسؤولية الطبيب القانونية في حالة ارتكابه لخطأ طبي ناتج عن إهمال أو رعونة أو عدم مراعاته للأنظمة والقوانين أو عن خطأ يقوم على الجهل بالحقائق والمسلمات العلمية الثابتة في علوم الطب ؛ لأن التزام الطبيب يعتبر التزاما ببذل عناية كأصل عام والتزام بتحقيق نتيجة كاستثناء. Abstract : We have tried, through this study, entitled "The Doctor's Responsibility for Medical Error", to clarify the concept of medical error, which is the result of the rapid development in the medical fields and the resulting increase in complexity and danger; The doctor’s legal responsibility may result in the event that he commits a medical error resulting from negligence, recklessness, non-observance of regulations and laws, or a mistake based on ignorance of scientific facts and established postulates in medical sciences. Because the physician’s commitment is considered an obligation to take care as a general principle and an obligation to achieve a result as an exception.
