صيغ و إجراءات إبرام اتفاقية تفويض المرفق العام المحلي (دراسة في أحكام المرسوم التنفيذي 18/199)

الملخص
ملخص: إن اتجاه المشرع الجزائري إلى إصدار المرسوم التنفيذي 18/199 المتعلق بتفويض المرافق العامة، يسمح بتعزيز أسلوب تفويض المرافق العامة لكونه وسيلة ناجحة تتخذها الجماعات الإقليمية لتسيير مرافقها العامة بغرض الرفع من جودة الخدمة العمومية وتقريب الإدارة من المواطن، وكذلك التخفيف من الأعباء التي تتحملها الخزينة العمومية. حيث تطرق هذا المرسوم إلى توضيح مختلف الجوانب التي يرتكز عليها هذا الأسوب، الذي يكون وفقا لأشكال متعددة تتمثل في: الامتياز، الإيجار، الوكالة المحفزة والتسيير. وتبرم اتفاقية تفويض المرفق العام وفقا لأسلوبين: الأول يتمثل في الطلب على المنافسة والذي يمثل القاعدة الأساسية، أما الثاني فيتمثل في التراضي الذي يشكل الاستثناء. كما جاء بمختلف الإجراءات التي تتطلبها عملية اختيار المتعاقد المناسب، ضمانا لنزاهة وشفافية عملية إبرام عقود التفريض، إذ تعد أهم و أخطر مرحلة. Abstract: The orientation of the Algerian legislator to issue Executive Decree No. 18/199 on the delegation of public service allows its consolidation since it is considered as an effective method that territorial authorities set up to manage their services in order to improve the quality of the public service, bring the administration closer to the citizens , and reduce the burden on the public treasury. The former decree has brought to light various aspects on which this method is based, which has been conceived in a variety of forms such as concession, rental, management of a public service on a concessionary basis (régie interessée ) ,and management. The agreement for the delegation of public service is concluded according to two methods, essentially by the call for tenders as well as the mutual agreement exceptionally, It mentioned also the various procedures required for the operation of selecting the appropriate contractor in order to guarantee the impartiality and transparency of the conclusion of delegation contracts considered as the most important and dangerous step
