إثبات النسب بالطرق العلمية في القانون الجزائري وإشكالياته

الملخص
يهدف هذا البحث إلى تسليط الضوء على الوسائل العلمية التي يمكن الاعتماد عليها لإثبات النسب حسب ما جاء بالمادة 40/2 من قانون الأسرة الجزائري، وما تقدير نجاعتها وقوتها في الإثبات، حيث تجاوزنا الإثباث التقليدي للنسب القائم على فراش الزوجية، حيث اعتمدنا في بحثنا هذا على العديد من المناهج على غرار المقترب القانوني من خلال التطرق لمختلف قوانين الأسرة، كما اعتمدنا على المنهج الوصفي التحليلي لوصف وتحليل الظاهرة محل الدراسة، كما توصلنا في بحثنا هذا إلى العديد من النتائج على غرار أن الطرق العلمية أتبثث نجاعتها الفعلية في إثباث النسب ذلك لما تعطيه من نتائج تكاد تكون حقيقية بنسبة مئة بالمئة وهذا حفاظا على تحديد هوية الأطفال في حال ضياعهم أو في حال اختلاطهم في المستشفيات أو مراكز رعاية الطفولة وحتى إثبات نسب أطفال مجهولين ( أطفال الزنا). كما قدمنا العديد من التوصيات التي قد تساهم في إثراء هذا الموضوع من الناحية القانونية. This research aims to clarify the importance of scientific methods that can be depend on it to prove parentage according to Article 40/2 of the Algerian Family Code, and to know the extent to which its efficacy in proof is estimated. Because today we do not rely on the classic evidence To prove the lineage. In this research, we relied on many scientific methods Like the legal approach By addressing various laws related to the family. and we also relied on the descriptive-analytical approach. because of the results they give that are almost one hundred percent real, , we reached many results, the most important of which is that these scientific methods have proven their actual efficacy in proving the lineage. because of the results they give that are almost one hundred percent real, This is in order to preserve the identification of children in the event of their loss or mixing in hospitals, and even to establish the parentage of unknown children we also presented a set of recommendations and scientific methodological suggestions that may contribute to enriching this topic from a legal point of view. Cette recherche vise à apparaitre l'importance des méthodes scientifiques sur lesquelles on peut s'appuyer pour prouver la filiation ou la décente selon l'article 40/2 du code de la famille algérien, et à savoir dans quelle mesure sont efficace. Car aujourd'hui on ne s'appuie pas sur les preuves classiques, c’est pour cela j’ai utilisé de nombreux méthodes scientifiques comme l'approche juridique, et également j’ai utilisé l'approche descriptive-analytique, pour atteindre de nombreux résultats dont parmi eux, que ces méthodes scientifiques ont déjà fait leurs preuves Puisqu'il est effectivement efficace pour prouver la filiation, parce que les résultats qu'il donne sont presque réels à cent pour cent. Est cela pour préserver l'identification des enfants en cas de perte ou de mélange dans les hôpitaux. Et même prouver la filiation d'enfants inconnus. Nous avons également fait plusieurs recommandations
