الإجارة المنتهية بالتمليك كآليـة تفعيلية للاسـتغــلالات الــوقفـية الفلاحـيـــة

الملخص
تعاني الاستغلالات الوقفية الفلاحية القائمة قانونا على عقود الحكر والمزارعة والمساقاة من حالة ركود، سببت شللا ملحوظا لمؤسسة الوقف في الجزائر، حال دون تحقيق اقتصاديات هذا الأخير من خلال التنمية والريع الوقفي المعتبر، وهو ما يستوجب تفعيلا لها من خلال الاستفادة من أحكام عقد الإجارة المنتهية بالتمليك وترجمة ذلك في شكل عقد اعتماد إيجاري لأصول منقولة تتعلق بالنشاط الفلاحي، وهو ما يتطلب توفير البيئة التشريعية والمصرفية المناسبة، والتي تتخذ من أحكام الشريعة الإسلامية ومن مقتضيات الوقف ومصلحته الفضلى أساسا لها. Abstract: The agricultural wakfs exploitations which legally based on emphyteutic lease and lease to compliant andpartial cloning contract suffering from a recession, that's what caused the damage for the waqf foundation, hindered the realization of the savings of these last by the development and the good income of wakf, which requires an activation taking advantage of the provisions of the leasing end by ownership, this translates into a credit-lease contract related to an agricultural activity, which requires the provision of the appropriate legislative and banking environment , which are based on the provisions ofthe Islamic shariah and the requirements and the best interests of the waqf.
