الملخص
إن الشركات التجارية عموما مفاتيح الرقي الاقتصادي و ميدان خلق الثروة، لذا فإن هناك من يطمح إلى استثمار مدخراته من خلال انشاء شركة تجارية ، خاصة شركات الأشخاص لما تتمتع به من سهولة في إجراءات التأسيس، إلا أن الاعتماد على الاعتبار الشخصي للشريك في هذا النوع من الشركات وما قد يترتب عنه من مسؤولية يمكنها أن تقضى على المستقبل التجاري للمستثمر المبتدئ في حالة فشل المشروع، من هنا يهدف موضوع الورقة البحثية إلى تبيان خصائص المراكز القانونية للشركاء في شركات الأشخاص و تسليط الضوء على حجم المسؤولية و خطورتها خاصة بالنسبة للشريك المتضامن فيكون على بينة من أمره قبل المجازفة في ولوج ميدان شركات الأشخاص التجارية . سيتم التعرف على الكيفية التي تناول بها المشرع الجزائري مركز كل واحد من الشركاء عن الآخر في كل من شركات: التضامن؛ التوصية البسيطة؛ المحاصة.
