فكرة الطرف الضعيف في ظل المعطيات الجديدة للعقد

الملخص
أدى تطور نظرية العقد إلى ظهور العديد من القواعد و المبادئ التي تخص الرابطة العقدية، والتي تهدف إلى ضبط استقرار المعاملات من جهة، و حماية الطرف الضعيف من جهة أخرى، ذلك لأن القواعد التقليدية لم تعد تتلاءم و التطورات الحاصلة في مختلف مجالات الحياة، فبعد أن كان ينظر للعقد أنه رمز للعدل و التوازن، أصبح اليوم يشكل مصدرا لاختلال التوازن، طرف قوي ينظم و يملي شروطه لصالحه في مواجهة الطرف الضعيف، الذي لم يكن له وجود إلا بظهور تشريعات خاصة تهدف كلها لحمايته و تعزيز مركزه في الرابطة العقدية، كل هذا أثار اشكالية تحديد مفهومه في ظل التطورات الحديثة. Abstract: The development of contract theory led to the emergence of many rules and principles that pertain to nodal bonds, which aim to control the stability of transactions on the one hand, and to protect the weak party on the other hand, because traditional rules no longer fit with developments in various areas of life. If the contract was seen as a symbol of justice and balance, today it is a source of imbalance, a strong party that organizes and dictates its conditions in favor of it in the face of the weak party, which did not exist except by the emergence of special legislations all aimed at protecting it and strengthening its position in the contractual association, all this He raised the problem of defining his concept in light of recent developments.
