المسؤولية الجزائية لأشخاص الشبكة الإلكترونية عن المحتوى المعلوماتي المبث من خلالها

الملخص
لا يمكن الحديث عن الشبكة الإلكترونية دون الحديث عن أشخاصها من وسطاء ومقدمي خدمات الانترنت ،الذين يتعددون و يختلفون باختلاف قدرة كل طرف ومدى مساهمته في إيصال محتوى الشبكة، فهناك من يقوم بدور تقني كما أن هناك من يقوم بدور فني على هذه الشبكة، بل وفي كثير من الأحيان ما تتداخل أدوارهم والتي على أساس ذلك تتحدد مسؤوليتهم وخصوصا مسؤوليتهم الجزائية في حالة إذا كان المضمون المعلوماتي غير مشروع، فدور متعهد الإيواء مختلف عن مزود خدمة الوصول ، وبدوره عن مورد المحتوى وكذا منظمي منتدى المناقشة والدردشة. ونظرا للدور المعقد لكل واحد منهم اتجهت أغلبية التشريعات - وعلى رأسها التشريع الجزائري- إلى إعفاءهم من المسؤولية الجزائية ، إلا وفقا لشروط أقل ما يقال عنها أنها تتجه لإسقاط عنهم المسؤولية الجزائية كلية عملا بما يقال أن الانترنت فضاء لا يحكمه القانون، كما أن إخضاعهم للمساءلة القانونية هو عرقلة لعملهم الذي يرتبط في الغالب بمبدأ حرية التعبير. In view of the complex role of each of them, the majority of legislation - especially the Algerian legislation - tended to exempt them from criminal responsibility by conditions which implies totally eliminated the criminal responsibility, in fact that the internet space does not manage by laws as it is hamper their applications under the principle of freedom of expressions.
