المستجد في عضوية المحكمة الدستورية: الضمانات وشروط الترشح

الملخص
تهدف هذه الدراسة إلى إلقاء الضوء على أهم المستجدات التي جاء بها التعديل الدستوري لسنة 2020 بخصوص عضوية المحكمة الدستورية، لاسيما ما تعلق منها بشروط الترشح لعضوية المحكمة الدستورية والضمانات القانونية التي تكرس حياد ونزاهة الأعضاء. وتوصلت الدراسة إلى أن المؤسس الدستوري ضمن تعديل 2020 تشدد في فرض شروط العضوية بالمحكمة الدستورية، لاسيما ما تعلق منها بالسن والخبرة والتخصص، وذلك من شأنه تقليص فرص التعيين وحصرها في نخبة مختارة من ذوي الكفاءات القانونية، وعلى الرغم من إقراره لضمانات عديدة لحماية أعضاء المحكمة الدستورية تكفل حيادهم ونزاهتهم واستقلاليتهم وعدم خضوعهم لأية تأثيرات خارجة عن محيط المحكمة الدستورية، إلا أنها تبقى قاصرة على التكفل بذلك في ظل عدم النص على عدم قابلية اعضاء المحكمة الدستورية للعزل. The study aims to highlight the most important developments in the 2020 Constitutional Amendment concerning the membership of the Constitutional Court, in particular those pertaning to the conditions for standing for membership in the Constitutional Court and the legal guarantees of neutrality and impartiality of members. The study found that the Constitutional founder of the 2020 Amendment tighen the imposition of conditions for membership of the Constitutional Court, particularly those relating to age, experience and specialization, by reducing recruitment opportunities and limiting them to selected legal professionals. And althought it's recognized for many safeguards to protect the members of the Constitutional Court to ensure their impartiality, and independence and they are not subject to any effects outside the context of the Constitutional Court, but they remain limited to ensuring that this is done in the absence of a provision that the members of the Constitutional Court cannot be dismissed.
