المراجعة الدستورية وتحقيق التحول الديمقراطي في الجزائر والمغرب

الملخص
: يتمحور هذا المقال حول إشكالية تحقيق التحول الديمقراطي، في الجزائر والمغرب، من خلال المدخل الدستوري، في خضم وجود تهديدات مجتمعية تزعزع استقرار النظام السياسي الحاكم، وتمس ببقاء الدولة نفسها. وتهدف الدراسة إلى فهم طبيعة الحل الدستوري ومدى استجابته لعملية التحول الديمقراطي، وقراءة السلوك السلطوي في البلدين إزاء معطيات الواقع، وخاصة ما تعلق بهندسة هذا التحول، إن وجد، في الاتجاه الذي يحقق مطلب الدمقرطة، وإنهاء حالة الخصومة بين السلطة والإرادة الشعبية، معتمدين على مجموعة من المناهج، كالتاريخي والمقارن والقانوني، لدراسة هذه الإشكالية، باستعراض مفهوم التحول الديمقراطي، ثم طبيعة النظامين السياسيين في البلدين، وأخيرا، فصْلنا مضمون التعديل الدستوري الذي شهده المغرب في 2011، وذلك الذي شهدته الجزائر في 2020. ولقد سجلنا، أن التعديل الدستوري ارتبط بأزمة الشرعية، فقد تم بعد مظاهرات احتجاجية ذات بعد وطني، ما جعلهما رد فعل يهدف لتهدئة الوضع، كما أنه تضمن تعديلات لم تمس بجوهر النظام السياسي. This article focuses on the problem of a achieving democratic transition, in Algeria and Morocco, through the constitutional approach, in the midst of societal threats that destabilize the ruling political system. The study aims to understand the nature of the constitutional solution, especially what is related to the engineering of this transformation, if any, in the direction that achieves the demand for democratization relying on a set of approaches, to study this problem, by reviewing the concept of democratic transformation, then the nature of the two political systems in the two countries, and finally, we detailed the content of the constitutional amendment 2011 and 2020. We have recorded that the constitutional amendment was linked to a crisis of legitimacy, which made it a reaction aimed at calming the situation. It also included amendments that did not affect the essence of the political system.
