استثمار الأموال الوقفية العامة في الجزائر

الملخص
الملخص: تملك الأوقاف في الجزائر حضورا اجتماعيا بارزا منذ زمن طويل، وقد قامت بأدوار حضارية كبيرة في صالح المجتمع الجزائري حتى في أحلك محطاته التاريخية الكبرى ولعلّ أخطرها مرحلة الاستعمار الفرنسي لها لأكثر من قرن وربع، هذا الدور الذي يتوافق مع طبيعتها التي شرعت من أجله أصبح اليوم محط اهتمام كبير في الواقع المعيشي للناس، ولفت نظر الجهات الرسمية إلى ضرورة الاهتمام بالأوقاف والعمل على تطوريها وتحسين أدائها التنموي، الأمر الذي يحتم التفكير في وضع رؤية استثمارية تتجاوز التعامل مع الأوقاف العامة على أنها أموال خير وصدقة توزع على مستحقيها وفق إرادة الواقف فحسب، بل تنتقل بها إلى مستوى احترافي أعلى يجعل منها أموالا تنمى وتتزايد من أجل بقائها أولا واستمرار عطائها ثانيا ومساهمة في عجلة التنمية المجتمعية التي تعود بالخير على المجتمع ومؤسساته ثالثا. لقد أصبح استثمار الأوقاف في وقتنا الحالي مسألة ضرورية وحيوية من أجل قيام الأوقاف بالدور المنوط بها، لأنّ تمام هذا الدور يقتضي وجودها واستمرارها، بما يعني تنميتها وتطويرها تجنبا لتهالكها مع الوقت، ولتحقيق هذا الهدف وضعت في الجزائر جملة من التشريعات المنظمة للاستثمار الوقفي انطلاقا من القانون 01/07 وصولا إلى مجموعة من المراسيم التنفيذية (14/70 و 18/213) المفصلة لذلك والتي تبرز الأنماط الاستثمارية التي تخضع لها الأوقاف العامة وتنمى من خلالها، فكل هذه النصوص القانونية المنظمة للعملية الاستثمارية الوقفية تهدف إلى التحسين من وضعية الأوقاف في الجزائر. Abstract: In Algeria, El wakf has an outstanding cultural presence since a long time ago. It participated in many civilized and beneficial movement for the Algerian society even in the worst historical period. The most dangerous period was during the French colonialism, for more than 1 century and quarter. It started mostly with this role and becomes a big interest to people’s life today. As a consequence, it attracted the authorities and obliged them to pay attention to El wakf and work to develop and ameliorate its developmental vision to treat El wakf not only as money of charity but also consider as source of a movement to a high and professional level. This makes money flourishes and increases. So as to use it and invest it in the wheel of development of society and institutions. The investment of El wakf becomes an important and vital issue to let El wakf doing its job. Because the achievement of El wakf’s is by its presence and continuation, it means by its development and prosperity. To reach this goal Algeria set a group of legislations specialized in El wakf investment starting from the law 01/07 and arriving to a group of executive decrees (18/213 and 14/70) specialized in it. This show types of investments that obey to El wakf and grow through them. All these laws helps investments of El wakf structure and aim to improve the situation of El wakf in Algeria.
