تطور مفهوم الجرائم ضد الانسانية في القضاء الجنائي الدولي

الملخص
تطور مفهوم الجرائم ضد الانسانية بشكل واضح مع مطلع التسعينات، عندما تفاجأ العالم بارتكاب جرائم فضيعة، أكثر قساوة وبشاعة من تلك التي حدثت في الحربين العالميتين، وكان مسرحهما يوغوسلافيا سابقا ورواندا، فتحركت النزعة الانسانية في المجتمع الدولي وهرع الى تحديد تعريف لهذه الجريمة ضمنه اعمالها واركانها وهذا من خلال النظام الاساسي للمحكمة الجنائية الدولية المؤقتة ليوغوسلافيا سابقا ثم من خلال النظام الاساسي لمحكمة رواندا، ثم جاء النظام الاساسي للمحكمة الجنائية الدولية الدائمة ليطور مفهوم هذه الجرائم من خلال تحديد تعريف دقيق لها تميز بالجمع والمنع اذ جمع فيه محاسن التعريفين السابقين ودرأ نقائصهما، وبذلك ساهم في تطوير خصائص هذه الجريمة بما يميزها عن بقية الجرائم التي يشملها اختصاصه الموضوعي، بعد ان تمكن من ضبط تعريفها The concept of crimes against humanity developed clearly at the beginning of the nineties, when the world was surprised by the commission of heinous crimes, more cruel and heinous than those that occurred in the two world wars, and their scenes were former Yugoslavia and Rwanda. Through the Statute of the Interim International Criminal Tribunal for the former Yugoslavia and then Through the Statute of the Court of Rwanda, then the Statute of the Permanent International Criminal Court came to develop the concept of these crimes by defining a precise definition of them distinguished by collection and prevention, in which he combined the advantages of the two previous definitions and redressed their deficiencies, and thus contributed to the development of the characteristics of this crime in what distinguishes it from the rest of the crimes that Covered by his substantive competence, after he was able to adjust its definition
