الاعتراض على إيداع وثائق المسح و أثر ذلك على الشهر العقاري . دراسة مقارنة

الملخص
يعتبر الشهر العقاري وسيلة لإعلان التصرفات القانونية المتعلقة بالحقوق العقارية في سجلات عينية بحيث يمكن الاطلاع عليها بكل سهولة ، فهو صورة واضحة عن للعقار وللحقوق الواردة عليه، إلا أن الشهر العقاري يستند على عملية أساسية تتمثل في المسح العقاري الذي تتجلى نتائجه في الوثائق المساحية التي تعد بمثابة الآلية المادية للمسح بالنظر إلى الكم الهائل من المعلومات التي تتضمنها بخصوص العقار ، وكلما اتسمت هذه الوثائق بالدقة انعكس ذلك على عمل المحافظ العقاري في عملية الترقيم و إعداد الدفتر العقاري ، لذلك فإن تنظيم آلية الاعتراض على هذه الوثائق قبل تسليمها للمحافظ العقاري يعد أمرا في غاية الأهمية بالنسبة لعملية الشهر العقاري سواء من الناحية المادية من خلال ضمان عدم إعادتها مرة أخرى ، فضلا عن عدم إنهاك المحافظ العقاري و مصالح المسح بمهام مضاعفة كلما تضمنت أخطاءا اعترض عليها أصحاب الحقوق ، وقد أظهر الواقع العملي وجود إشكالات عدة بخصوص إيداع وثائق المسح وطريقة الاعتراض على مضمونها مقارنة بالتشريعات التي أولت أهمية بالغة لهذه المرحلة وعيا منها بأهميتها في نجاح عملية الشهر العيني بأكملها . The real estate registry is a means of announcing the legal actions related to real estate rights in the real estate records, It is a clear picture of the property and the rights contained on it However, the real estate registry is based on a basic process represented in the real estate survey, the results of which are reflected in the cadastral documents, which are the physical mechanism of the survey, given the large amount of information it contains regarding the real estate, Therefore, organizing the mechanism of objection to these documents before handing them over to the real estate governor is a very important matter for the real estate registration process, both in terms of materiality by ensuring that they are not returned again. The practical reality has shown the existence of several problems regarding the deposit of survey documents and the method of objecting to their content, compared to the legislation that attached great importance to this stage, conscious of its importance in the success of the entire process of the month in kind.
