الملخص
قد يحدث وأن تدار شركة المساهمة من طرف شخص لا يملك صفة المسير القانوني، يطلق عليه المسير الفعلي، وهو مفهوم جرى استعماله من طرف القوانين التجارية المقارنة، وساهم الفقه والقضاء في وضع شروطه وبيان معالمه، ويعتبر التدخل في تسيير شركة المساهمة واحدا من أهم هذه الشروط. نحاول من خلال هذه الدراسة تسليط الضوء على هذا الشرط، ضمن الحديث عن التأصيل النظري للتدخل في التسيير كشرط لإضفاء صفة المدير الفعلي في محور أول، والتطبيقات القضائية لهذا التدخل في محور ثان. It may happen that the joint-stock company is managed by a person who does not have the status of a legal manager, called the actual manager, and it is a concept that has been used by comparative commercial laws, and jurisprudence and the judiciary have contributed to setting its conditions and indicating its features, and interference in the management of the joint-stock company is one of the most important of these conditions. . We are trying through this study to shed light on this condition, within the discussion of the theoretical rooting of the intervention in management as a condition for imparting the character of the actual manager in the first axis, and the judicial applications of this intervention in the second axis
