الملخص
الملخص: تعتبر الأملاك الشاغرة أحد أهم مكونات الأموال العامة، الأمر الذي جعلها محل إهتمام صانعي القرار في مختلف الدول، فكان سعيهم لتنظيمها وحمايتها والمحافظة على دوام تواجدها، وذالك من خلال إصدار عديد النصوص التشريعية والتنظيمية الكفيلة بتحقيق الغاية المنشودة المتمثلة أساساً في توسيع نطاق الملكية العامة وإبراز سيادة الدول. لذا ستحاول هذه الورقة البحثية تسليط الضوء على جملة الأحكام والنصوص القانونية والتنظيمية المعتمدة لتنظيم هذا الموضوع والوقوف من خلالها على مفهوم الشغور المنشود من قبل المشرع الجزائري تماشيا وواقع الظروف الاجتماعية والاقتصادية والسياسية الذي فرض تبني ما حملته تلك النصوص حسب فترة سريان كل منها. Abstract : Vacant property is one of the most important elements of public funds. That is why it was in the interest of policy makers in various countries to seek to regulate, protect and maintain the continuity of its presence by issuing several pieces of legislation and regulations to expand the scope of public ownership and to enhance sovereignty of states. This paper will attempt to shed light on the legal and regulatory provisions adopted as well as the provisions adopted to regulate this subject and thus identify the concept of vacancy sought by the Algerian legislator, in accordance with the reality of social, economic conditions. and policies, which forced the adoption of what these provisions and texts carried according to the validity of each margin..
