أثر جائحة كورونا على تأجيل الأحكام القضائية

الملخص
الملخص: يشهد العالم حدثا صحيا نادرا، يتمثل في جائحة كورونا (COVID-19)، سرعة انتشاره وتحوره، صعّب من مهمة الباحثين والمختصين في إيجاد علاج أو لقاح فعال له، وكانت له آثار سلبية ليس فقط على المستوى الصحي ولكن امتدت لتشمل جميع المستويات الاقتصادية. الاجتماعية، السياسية، الثقافية، وولجت عنوة إلى الجانب القانوني فخلفت آثار قانونية على علاقات الأشخاص التعاقدية والتزاماتهم، فسارع المشرع الجزائري إلى منح السلطة التقديرية لرؤساء الجهات القضائية لتطبيق المادة 322 من قانون الإجراءات المدنية والإدارية لمجابهة سقوط الآجال والمواعيد القانونية، واتخذ جملة من التدابير أهمها تقييد العمل القضائي بضوابط وشروط وقائية كالتأجيل المؤقت لتنفيذ العقوبات السالبة للحرية للأشخاص الموجودين في حالة إفراج، وتأجيل جلسات جميع القضايا المتطورة، ووضع آليات معاصرة لمواجهة هذا الظرف الاستثنائي كتطبيق آلية المحاكمة عن بعد في القضايا الجزائية خاصة، وإطلاق خدمة التقاضي عن بعد للحد من انتشار الفيروس. Abstract: The world is witnessing a rare health event, represented by the Corona pandemic. Its fast-spreading and highly contagious variants, which are barriers that make them difficult for scientists to find an effective treatments or vaccine for covid 19. The pandemic hasn't been only affecting the health system, but it also affected political, economic and societal prospects, and accessed into the legal aspect, had legal effects on people's contractual relations and obligations. The Algerian legislator has been quick to grant the discretionary power to the heads of the judicial authorities to apply Article 322 of the Civil and Administrative Procedures Law for facing the fall of deadlines and legal deadlines. He has taken a series of measure, most importantly was restricting judicial work with preventive controls and conditions, such as the temporary postponement of the execution of sentence of imprisonment for persons on release, and adjournment of all advanced cases, and developing contemporary mechanisms to confront this exceptional circumstance, by applying the remote hearings especially in criminal cases, and launching the remote litigation service to stop spreading the virus
