حدود صلاحية لجنة الإشراف على التأمينات في المجال العقابي

الملخص
باعتبار أن القيام بالمهام الضبطية لا يتأتى من غير عقوبات تفرض على المخالفين، خول المشرع لجنة الإشراف على التأمينات صلاحيات تمكنها من آدائها لمهامها، والتي من بينها سلطة القمع، هذه السلطة يقابلها التزام اللجنة باحترام حقوق الأعوان الاقتصاديين حال إقرارها لعقوبات في حقهم. غير أن الممارسة الفعلية للسلطة القمعية للجنة محدود نظرا لعدم منحها صلاحيات كافية تسمح لها بممارسة السلطة المنوطة بها في هذا المجال، نظرا لاحتفاظ الوزير المكلف بالمالية بسلطة اتخاذ أخطر وأهم العقوبات في مجال التأمين، كما أغفل المشرع إقرار ضمانات كافية متعلقة بحقوق الأعوان الاقتصاديين في مواجهة السلطة القمعية للجنة، رغم أهمية ذلك في تكريس مصداقية وشفافية آداء هذه الأخيرة. Considering that performing regulatory missions doesn’t come without penalties imposed on offenders, the legislator has empowered the Insurance Supervision Committee with powers that enable it to perform its missions, among which is the power of repression. This power is coupled with the committee's obligation to respect the rights of economic agents in the event of a penalty being imposed on them. However, the actual exercise of the committee’s repressive power is limited due to the failure to grant it sufficient and effective powers to allow it to exercise its missions, given the fact that the Minister in charge of Finance retains the power of taking the most serious and important sanctions in the field of insurance. In addition to that, the legislator has neglected to establish sufficient guarantees related to the rights of economic agents against the repressive authority of the committee , despite the importance of this in the establishment of the credibility and transparency of the commitee's action
