السياسة للجنائية لمواجهة بث خطاب الكراهية عبر موقع التواصل الاجتماعي(فيسبوك) "دراسة تحليلية في التشريع الفلسطيني"

الملخص
تناول الباحث موضوع السياسة للجنائية لمواجهة بث خطاب الكراهية عبر موقع التواصل الاجتماعي(فيسبوك)، وقد اتبع الباحث المنهج الوصفي التحليلي، وتوصل من خلال هذا البحث إلى عدد من النتائج منها: خطاب الكراهية يؤدي الى توتر الاستقرار الأمني للمجتمعات. خطاب الكراهية سبب اساسي في ارتكاب العدي من الجرائم. هناك فرق بين خطاب الكراهية وحرية الرأي والتعبير. موقع التواصل الاجتماعي لا يتبع سياسة المساواة بين الشعوب في مراقبة المحتوى. التشريع الفلسطيني لم يساهم بالشكل المطلوب في منع خطاب الكراهية. وعليه توصل الباحث إلى عدد من التوصيات من أهمها: دعوة المشرع الفلسطيني إلى سن تشريع واضح يميز فيه بين خطاب الكراهية وحرية الرأي والتعبير بشكل واضح. دعوة المشرع الفلسطيني إلى فرض عقوبات أشد على الاشخاص الذين يستخدموا موقع التواصل الاجتماعي لبث النعرات الطائفية وخطاب الكراهية. دعوة المشرع الفلسطيني إلى اضافة مادة جديدة إلى القرار بقانون تتيح مراقبة المحتوى العام ومنع نشره إذا كان فيه اثارة للنعرات الطائفية وتحريض على العنف والكراهية. The researcher addressed the topic of criminal policy to counter the dissemination of hate speech on social media (Facebook). The researcher followed the analytical descriptive approach. Through this research, he reached a number of findings, including: hate speech strains the security stability of societies. Hate speech is an underlying cause of aggression. There is a difference between hate speech and freedom of opinion and expression. The social media site does not follow the policy of equality between peoples in content control. Palestinian legislation has not contributed as required to the prevention of hate speech. The researcher therefore reached a number of recommendations, the most important of which being to call on the Palestinian legislature to enact clear legislation that clearly distinguishes hate speech from freedom of opinion and expression. To call on the Palestinian legislator to impose harsher penalties on people who use the social media site to spread sectarian strife and hate speech. To call upon the Palestinian legislature to add a new article to the resolution by a law that would allow for the control and prevention of public content if it provokes sectarianism and incites violence and hatred.
