ماهية العقود الذكية و دورها القانوني

الملخص
لقد اكتسحت تكنولوجيا المعلومات و تحليلات البيانات و التطورات في شبكات الحاسوب العالم اليوم، فغيرت النمط المتعارف عليه في العقود ،ما ولدت هذه التطورات الحديثة في التقنيات المستندة إلى الإنترنت، مثل blockchain والذكاء الاصطناعي، ما كان لهذه العقود أثرا واضحا، إذ دفعت هذه التكنولوجيا بالصناعة إلى الإستجابة إلى التطور السريع في نمط المشروعات و كذا الأخطار المحيطة بها حتى تتمكن من الإستمرار في تزويد العملاء بالدعم و الحماية و التي يحتاج إليها من أجل تحقيق التطور و الإزدهار، و تسريع عملية تطوير المنتجات و الخدمات لتلبية احتياجات العملاء و كذا خلق نماذج أعمال جديدة تدعم احتياجاتهم، مما تجعل الوقت مثالي للنظر في كيفية استخدامها لحل تحديات الصناعة وخلق الفرص جديدة، فتُعتبر هذه التقنيات هي الوسيلة التي يمكن من خلالها تحقيق نظرية العقود الذكية Nick Szabo بالكامل. فالإشكال المثار هنا ماهية هذه العقود الذكية؟ و ما هو الدور القانوني المنوط بها؟ Abstract : Information technology, data analytics and developments in computer networks have swept the world today. And I changed the pattern in the decades, which generated these new advances in Internet-based technologies. like blockchain and artificial intelligence, these decades have had no obvious impact. this technology has prompted industry to respond to the rapid evolution of the pattern of projects as well as the risks surrounding them so that they can continue to provide customers with the support and protection they need in order to achieve development and prosperity, Accelerate the development of products and services to meet customer needs as well as create new business models that support their needs which makes it an ideal time to consider how it can be used to solve industry challenges and create new opportunities, These techniques are the means by which Nick Szabo's intelligent contract theory can be fully realized. Résumé: Les technologies de l’information, l’analyse de données et les développements dans les réseaux informatiques ont balayé le monde d’aujourd’hui, changeant le modèle vieux de plusieurs décennies, générant ces développements récents dans les technologies basées sur Internet, telles que la blockchain et l’intelligence artificielle, Ces contrats ont eu un impact évident, car cette technologie a incité l’industrie à réagir au développement rapide du modèle de projets et aux risques qui les entourent afin qu’ils puissent continuer à fournir aux clients le soutien et la protection dont ils ont besoin pour atteindre le développement et la prospérité, accélérer le processus de développement de produits et de services pour répondre aux besoins des clients et également créer de nouveaux modèles commerciaux.Répondant à leurs besoins, ce qui en fait un moment idéal pour réfléchir à la façon de les utiliser pour résoudre les défis de l’industrie et créer de nouvelles opportunités, ces technologies sont le moyen par lequel la théorie des contrats intelligents de Nick Szabo peut être pleinement réalisée.
