المؤثرات السياسية والفكرية في منهج التأليف والتصنيف في السياسة الشرعية عند المتقدمين

الملخص
المقال يتناول بالعرض والتحليل أغلب العوامل والأسباب الفكرية والسياسية التي تأثرت بها مناهج التأليف والتصنيف عند القدامى في مجال السياسة الشرعية والفكر السياسي عموما، فكانت أشبه بالعقبات التي وقفت في طريق تجديد الفقه السياسي وحالت دون تطويره ومن تم انغلاقه وجموده. وكذلك حالت دون الإبداع الفقهي في الصياغة والتأليف ودون التحرّر الفكري في المعالجة والتحليل والنقد والتصويب للأوضاع السياسية ومسارات الحكم والسلطة طوال قرون من السنين. ومن هذه العوامل المؤثرة: ضعف العناية والاهتمام بالفقه السياسي وطغيان نزعة الجمود والتقليد، اعتماد المنهج الفروعي التفصيلي وغياب المنهج الغائي التحليلي المقاصدي، تأثير أنظمة الاستبداد والتضييق على الحريات، طغيان الفقه السياسي على الفكر السياسي. إن هذا العرض وذلك التحليل احتاج إلى مقدمة بينا فيها مختلف أنظمة القول السياسي وأنواع الخطابات السياسية كما ذكرنا الدوائر الأساسية التي دارت عليها كتب ومؤلفات الفقه السياسي خاصة والفكر السياسي عامة في الزمن المتقدم. كما احتاج إلى خاتمة خلصنا فيها إلى نتائج، دعونا فيه إلى ضرورة التحرّر من هذه الآفات وتلك المعوقات، حتى تتواصل فيها كل الخطابات وأنظمة القول السياسي المتنوعة مع مصادر الإسلام الأساسية وتتحرّر حينها من كل العوائق التي تقف في طريق التطوير والتجديد وتسمح له حينها باستيعاب الواقع وإيجاد الحلول للأزمات السياسية الخانقة. The article deals with the presentation and analysis of most of the intellectual and political factors and causes that affected the methodes of authorship and classification among the elders jurisconsultes in the field of legal politics and political thought and authoring and without intellectual liberation in the treatment, analysis, criticism and correction of political situation and the paths of governance and power over centuries from these influencing factors we mention: Weak attention to political jurisprudence and predominance of stagnation and tradition, Adoption of the detailed sub-method and the absence of the intended analysis teleological approach, The effect of tyranny and restriction regimes on freedoms, The predominance of political jurisprudence over political thought.This presentation and that analysis needed an introduction in which we showed the various systems of political sayings and types of political discourses, as we mentioned the main circles on which books and writings of political jurisprudence in particular and political thought in a general look place in the advanced age. It also needed a conclusion in which we called for the necessity of liberation from these spyware and those obstacles, so that all the various discourses and political sayings systems communicate with the basic sources of Islam and be freed at the time from all obstacles that stand in the way of development and renewal, and allow it to absorb reality and find solutions to suffocate political crises.
