الملخص
مثَّلَ العقاب عنصرا أساسيا من عناصر العملية التربوية في المنهج التربوي الإسلامي خلال العصر الوسيط، غير أن آلية عقاب المتعلمين وتأديبهم تختلف وتتباين درجاتها على قدر الخطأ المرتكب، ويمكننا أن نميز نوعين أساسيين من العقاب: لفظي وبدني، فالغالب والمألوف هو ضرب المتعلم المراد معاقبته بالفلقة أسفل القدم، وتحدد عدد الضربات وكيفيتها على حسب الجرم المرتكب، على أن لا يتجاوز المعلم في ضربه للتلميذ العشر ضربات كأقصى حد، وقد يؤدي العقاب في بعض الأحيان بالتلميذ إلى الموت! هذا في حالة ما إذا زاد العقاب عن حده. ولغرض ضبط مثل هذه الممارسات التربوية عمل العلماء على تبيين كيفيتها ووقتها وطريقتها، فأورد الفقهاء في فتاويهم مظاهر لمثل هذه الممارسات، وبينوا حكمها الشرعي وتكلم المربين عن حيثياتها وحينها ووقت وجوبها وعلى من تجب وهو ما تزخر به مؤلفات علماء العالم الإسلامي عامة والمغرب خاصة. فما هي أساسيات العملية العقابية في المنهج التعليمي في المغرب الإسلامي؟ وما هي الوسائل والخطوات والأساليب المنتهجة في تطبيق الفعل العقابي؟ وهل العقاب وسيلة فاعلة تحقق التأديب؟ Punishment represents an essential element of the educational process for Muslim scholars in the medieval era, but the methods of punishing and disciplining learners varied and their degrees varied according to the amount of the error committed, and we can distinguish two basic types of punishment: verbal and physical. The jurists cited in their fatwas manifestations of such practices, and explained their legal ruling, and educators spoke about their merits, time, and time for them to be obligatory, and this is what the writings of scholars of the Islamic world in general and Morocco in particular abound with.
