الملخص
ملخص: تعالج هذه الورقة البحثية موضوع تطبيق القواعد الدولية المتعلقة بحقوق العمال المهاجرين وأفراد أسرهم، باعتباره من أهم الموضوعات التي تمس شريحة واسعة من المهاجرين، الذين دفعتهم ظروف بلدهم إلى الهجرة بحثا عن حياة كريمة لهم ولعائلتهم إلا أن المعاملة السيئة والاستغلال الذي تم التعرض له، جعل المجتمع الدولي يتحرك لتقنين أوضاع العمال المهاجرين وأفراد أسرهم، من خلال انشاء اتفاقية دولية خاصة بهم، والتي نصت على انشاء لجنة مهمتها القيام بمراقبة تنفيذ أحكام الاتفاقية من خلال إجراءين رئيسيين، يتمثل الأول في إعمال نظام التقارير والثاني يتعلق بنظام الشكاوى بنوعيها، وبالإضافة إلى هذه اللجنة هناك المقرر الأممي الخاص بحماية العمال المهاجرين. وتبرز أهمية هذه الورقة البحثية في تبيان مدى التزام الدول بتنفيذ التزاماتها التعاقدية. وتوصلت الدراسة إلى جملة من النتائج أهمها: عدم التكفل التام بفئة العمال المهاجرين وأفراد أسرهم مرده تخلف العديد من الدول في المصادقة أو الانضمام إلى هذه الاتفاقية. كلمات مفتاحية: حقوق الإنسان، العامل المهاجر، اللجنة المعنية بحماية حقوق العمال المهاجرين، المقرر الخاص Abstract: This research paper deals with the issue of the applycation of the international rules related to the rights of the migrant workers and the members of their families, which is considered as one of the most important issues that affects a large segment of immigrants, who due the conditions of their countries they were firced to migrate in search of a decent life for themselves and for their families, but the ill-treatment and exploitation that they were subjected to, made the international community move to legalize the conditions of migrant workers and the members of their families, through establishing an international convention for them, which stipulates the establishment of a committee whose mission is to monitor the implementation of the provisions of the convention through two main procedures, the first is the implementation of the reporting system and the second is related to the complaints system of both types, and in addition to this committee there is The UN Special Rapporteur on the Protection of Migrant Workers. The importance of this research paper highlights the extent to which countries are committed to implementing their contractual obligations. The study reached a number of results, the most important of which are: The lack of full support for the category of migrant workers and their families is due to the failure of many countries to ratify or accede to this agreement .Keywords: Human right, The Immigrant Worker, the Committee on the Protection of Migrant Workers' Rights , Special Rapporteur
