الاتجاهات الحديثة للتحكيم التجاري الدولي بالجزائر في علاقته بالاستثمار وفقا للقانون 08 ـــ 09 والقوانين المقارنة

الملخص
ملخص: بتزايد الحاجة إلى التجارة الدولية، والاستثمار في المشاريع التنموية، أضحت الشركات متعددة الجنسيات تمثل الطرف التقليدي لعقود الاستثمار في مواجهة الدولة الوطنية، المعنية أساساً بتوفير الظروف المناسبة للمستثمرين. ولما كان خيار التحكيم هو الأكثر انسجاما مع عقود الاستثمار حيث السرعة والسرية، فإن الجزائر عملت كغيرها من الدول على مواكبة هذا النظام الجدید بتكييف نظامها القانونی، مع توجهاتها الجدیدة. وإذ تهدف هذه الدراسة إلى بيان آثار انفتاح الجزائر على التحكيم الدولي، فإنها ستسلط الضوء على الاتجاهات الحديثة التي تحكم الاستثمار في علاقته بالتحكيم الدولي في ظل هذا القضاء البديل وفقا للقانون 08 ــ09 المتعلق بالإجراءات المدنية والإدارية والمتضمن أحكام التحكيم التجاري الداخلي و الدولي. كلمات مفتاحية: الاستثمار، المنازعات، القضاء الوطني، التحكيم الدولي، الجزائر. Summary: With the increasing need for international trade and investment in development projects, multinational companies have become the traditional party to investment contracts in the face of the national state, which is primarily concerned with providing appropriate conditions for investors. Since the arbitration option is the most consistent with investment contracts in terms of speed and confidentiality, Algeria, like other countries, has worked to keep pace with this new system by adapting its legal system to its new orientations. While this study aims to demonstrate the effects of Algeria’s openness to international arbitration, it will shed light on the recent trends that govern investment in its relationship with international arbitration under this alternative judiciary in accordance with Law 08-09 related to civil and administrative procedures, which includes provisions for internal and international commercial arbitration.
