التَّخريج وأثره في معرفة الأحكام الشَّرعيَّة المتعلِّقة بفيروس كورونا

الملخص
يسعى هذا البحث إلى بيان دور التَّخريج في التعرف على الأحكام الشرعية لكثير من أحوال وتصرفات المُكلَّفين المتعلقة بالعبادات والمعاملات والشأن العام التي تقع لهم أثناء النوازل والحوادث كما هو الحال في جائحة فيروس كورونا المستجد (كوفيد 19)، ومدى أهمِّية هذا المسلك في التوافق مع التدابير والاجراءات الوقائية الاستثنائية التي اتخذتها دُولٌ كثيرة. وقد تبين بأن التَّخريج يعتبر من أهم الأدوات الاجتهادية التي تُؤكد صلاحية الشريعة الإسلامية لكل زمان ومكان، وأنَّ أغلب أحكام النوازل قائمة على قاعدة رعاية المصالح وتكثيرها ودفع المفاسد أو تقليلها. Abstract : This research seeks to demonstrate the role of graduation in identifying the legal provisions of many of the conditions and actions of those charged with worship, transactions and public affairs. These actions may occur to them during the conflicts and incidents, as in the emerging COVID-19 pandemic. In addition to the importance of this course in conformity with the exceptional preventive measures and measures taken by many states. Graduation has been found to be one of the most important tools of jurisprudence that affirms the validity of Islamic law for all time and place, and that most of the provisions of the downwards are based on the rule of caring for interests and multiplying them as well pushing or reducing the evils.
