الملخص
ملخص: تسعى هذه الورقة البحثية إلى الحديث عن نازلة لطالما شغلت اهتمام الفقهاء وأسالت حبر العديد من علماء المغرب العربي الإسلامي؛ ألا وهي نازلة إثبات شرف النسب من جهة الأم، والتي انقسم حولها مجموع العلماء إلى فئتين: فئة مؤيدة وأخرى معارضة، وإنّا في هذا الباب لن نقف موقف المفتي أو المعلل للمسألة، فهذا اختصاص أهل الفقه والفتوى، وإنما سنعمل على إبراز اجتهاد علماء المغرب والجزائر، في الرد على من يستفسر في شأن شرعية النسب من جهة الأم الشريفة، والأبُ ليس شريفا. وقد اخترت لهذا الموضوع نموذجين من نماذج فتاوى شرف النسب من جهة الأم، لعالمين كبيرين جليلين، وهما الإمام محمد المراكشي الأكمه(739ه-807ه)، والإمام محمد بن مرزوق الحفيد العجيسي التلمساني (766ه-842ه)، فقد خاض كلٌّ منهما في الإفتاء حول هذه النازلة، كلّ بأسلوبه ومنهجه وفتواه، فكانت للمراكشي الأكمه رسالة بعنوان:"إسماع الصّم في إثبات الشرف من قبل الأم" ،كما كانت لابن مرزوق الحفيد رسالة في هذه النازلة أسماها" إسماع الصّم في إثبات الشرف للأم"، وقد أفاض العالمان في هذا الباب، مثبتين واسع علمهما ودقة أجوبتهما، انطلاقا من أدلة شرعية تستمد قيمتها من الكتاب والسنة النبوية الشريفة. Abstract This paper seeks to talk about a Fiqh issue that has always attracted the attention of jurists. Many scholars of the Arab Islamic West, have brought the proof of the honor of descent on the mother's side to two categories: opposition, In this section, we will not stand the position of the Mufti or the interpreter of the matter. This is the jurisdiction of scholars and fatwas, but I will work to highlight the jurisprudence of the scholars of Morocco and Algeria in responding to those who inquire about the legitimacy of descent from the honorable mother. I have chosen for this subject, two models of the Fatwa of the honor of descent on the mother's side, for two great scholars, the imam mouhammed al marrekchi al akmah(739h- 807h) and mouhammed ibn marzouq alhafid al talimsani (766h-842h) Each of them in the fatwa on this debacle, fought every style, method and fatwa. Marrakesh al-Akma had a message entitled "Hearing the Deaf in Honor of the Mother." The son of Marzouq also had a message in this " "The two worlds have expanded in this section, affirming their broad knowledge and the accuracy of their answers, based on legitimate evidence derived from the book and the Noble Sunnah.
