علاقة القانون بالأخلاق في نُظُم المجتمع الثقافية دراسة في الآيات الأولى من سورة الحجرات

الملخص
القانون والأخلاق عنصران رئيسيان في بنية المجتمعات البشرية، والهدف منهما تنظيم السلوك الاجتماعي للإنسان. إن انعدام التوازن والانسجام بين السلوك الأخلاقي والقانوني يسبب عدم استقرار المجتمع وربما يتفاقم الوضع فيصل لدرجة تبرير السلوك غير الأخلاقي، بحجة موافقته للقانون في وجه قادة المجتمع. اسلوب البحث في المقاله : هذه المقاله يبتني علي البحث التاريخي و التفسيري و الروايي علي الدراسه في سوره الحجرات . هذه المقاله يشتمل علي مطالب حول هذه المباحث : لقد قام الرسول الأكرم (ص) ببناء المجتمع الأخلاقي في تلك الحقبة التاريخية، ولكن التطور الثقافي والقانوني أدّى إلى ابتعاد المجتمع شيئاً فشيئأ عن مسيره الأخلاقي، و لم تتوفر المراقبة الأخلاقية حتى في السلوك مع الرسول (ص) أيضاً. في هذه المقالة تم التعريف بالأصول والجذور التي ترجع إليها التحذيرات والإنذارات القرآنية في سورة الحجرات، بسبب عدم رعاية الأخلاق، واستنتجنا أن حركة المجتمع نحو السيادة القانونية والفقهية أدت إلى نسيان المسائل الأخلاقية، والابتعاد عنها، وبالتالي صار السلوك مع الرسول (ص) بشكل استلزم تحذير الله تبارك وتعالى منه، لأنه يؤدي للخروج من دائرة التقوى وبالتالي حبط الأعمال. ولذا الرسالة الرئيسة للآيات الخمس الأولى التي هي مادة الدراسة في هذه المقالة هي، اذا اراد المجتمع ان يصبح مجتمعاً دينياً، يجب أن يكون أخلاقياً في نفس الوقت الذي يكون فيه قانونياً و شرعیّاً. Title: The relationship of law with ethics in the cultural systems of society Study in the first verses of Surat Al-Hujurat Abstract: Law and ethics are two main elements in the social structure of human societies to regulate social behaviors. The lack of balance and harmony between moral and legal behavior causes instability in society and may worsen the situation, to the point of justifying unethical behavior, on the pretext that it agrees with the law in the face of community leaders. Research method in the article: This article builds on historical, interpretive, and narrative research on the study of Surat Al-Hujurat. This article includes demands on these subjects: The Holy Prophet (PBUH) built the moral community in that historical era, but the cultural and legal development led to the society turning away little by little from its moral path, and moral observation was not available even in behavior with the Messenger (PBUH) as well. In this article, the origins and roots to which the Qur'anic warnings and warnings refer to in Surat Al-Hujurat were explained, due to lack of ethics care, and we concluded that the movement of society towards legal and juridical sovereignty led to the forgetting of moral issues, and away from them, and thus the behavior with the Messenger (PBUH) became in a way that necessitated a warning God Almighty blessed him, because he leads out of the circle of piety and thus frustrates the deeds Therefore, the main message of the first five verses that are the subject of study in this article is, if society wants to become a religious community, it must be ethical at the same time that it is legal and legal.
